Terms of Service

1. General provisions
These Terms of Service (the “Terms”) govern the relationship between the IT Tender platform (the “Platform”) and any individual or legal entity using its services (the “User”).
IT Tender is an information marketplace for IT-sector tenders: publishing technical specifications, submitting commercial proposals from IT companies, and selecting an IT-solution provider.
Using the Platform constitutes unconditional acceptance of all of these Terms. If you do not agree with them, stop using the service immediately.
2. Registration and account
- Each organization may register only one account.
- The User is responsible for keeping their account credentials confidential.
- Sharing account access with third parties is prohibited.
- Accurate information about the organization must be provided at registration.
- The Platform may suspend or delete duplicate accounts.
3. Rules for posting tenders
Tender organizers must:
- Provide an accurate and complete technical specification.
- State realistic submission deadlines and a budget.
- Review submitted applications in good faith.
- Notify participants of the tender results.
- Post only tenders that involve a genuine selection of a contractor.
It is prohibited to:
- Post tenders with no intention of running them.
- Collect commercial proposals for purposes unrelated to the tender.
- Discriminate against participants based on their size, region, or affiliation.
4. Rules for submitting applications
When submitting applications, IT companies must:
- Provide accurate information about the company and the proposed solution.
- State realistic pricing and delivery timelines.
- Hold the legal right to offer the stated technologies and software.
- Not copy other participants’ proposals.
It is prohibited to submit applications for:
- IT solutions that infringe copyrights or license agreements.
- Software or services prohibited by the legislation of the Republic of Tajikistan.
- Solutions containing malicious code or spyware components.
5. Rights and obligations of the Platform
The Platform may:
- Refuse to publish a tender or application that violates these Terms.
- Block or delete accounts in case of systematic violations.
- Request supporting documents to verify organizations.
- Change the service’s functionality without prior notice.
- Disclose information to authorized government bodies in cases provided for by law.
The Platform acts as an information intermediary and is not responsible for the performance of agreements reached between tender organizers and IT companies.
6. Limitation of liability
The Platform is not responsible for:
- The accuracy of information stated in tenders and applications.
- The quality of IT solutions proposed by participants.
- Disputes arising between organizers and contractors.
- Technical failures, temporary unavailability of the service, or data loss due to force-majeure circumstances.
- Unauthorized access to accounts caused by the users themselves.
7. Intellectual property
By posting a tender or application on the Platform, the User grants the Platform a free, non-exclusive right to display and reproduce that content as part of operating the service.
All trademarks, logos, and software of the Platform are the intellectual property of IT Tender. Their use without written permission is prohibited.
8. Changes to the Terms
The Platform may amend these Terms. A new version takes effect upon publication on the site. Continued use of the service after publication of changes constitutes acceptance of them.
9. Governing law
These Terms are governed by the legislation of the Republic of Tajikistan. All disputes are resolved through negotiation and, failing agreement, in court at the Platform’s location.
